$333,000 in Back Pay

(em,lctt,mt,o,rtb,spa&u), DENVER, COA new Traffic Signal Organizing Committee has been formed in Unit 1TS, and include Bros. Tom Jividen, Jeff Bunker and James Cole.

Outside Line Construction Organizer Sean McCarville will be forming other construction units and more committees. Bro. McCarville has been meeting with directional drill contractors to encourage them to sign letters of assent to the Statewide Line Agreement. Contacts with employees at nonunion companies continue in order to "spread the word about the benefits of belonging to the IBEW." McCarville and Eighth Dist. Organizer Bruce Buckner have also met with union and nonunion journeymen going through upgrade training at the Mesa State College hot line school in Grand Junction.

A lawsuit filed in District Court against Public Service Company by Local 111 over violation of the Fair Labor Standards Act has been settled in the unions favor. The union charged that the company had incorrectly paid the newly organized designers in the Design Department as "exempt" employees when they should have been "non-exempt" under the Fair Labor Standards Act. The Court ruled that the employees were "non-exempt" and awarded the 29 affected employees approximately $333,000 in back pay. The union also received $53,853 for attorneys fees and expenses.

Increasing VDV Work

(c,i&st), KENNEWICK, WAAt this writing in mid-November, we have found ourselves with a very quiet work picture.

The Waste Treatment Plant (the project formerly known as Vitrification) is reportedly eight to 12-months behind schedule. The manpower is holding on, but not projected to increase for some time. If our current work picture does not improve, anyone signing Book II at this writing could likely be waiting until January for a call out.

The good news for our jurisdiction is that our market share in Voice Data and Video has been steadily increasing and we believe this trend will continue in the future.

Longtime Contractor Retires

L.U. 115 (i&o), KINGSTON, ON, CANADAThe local has seen a few changes over the past several months, one being the change of business manager/financial secretary. After 27-plus years of running the local, Bro. Richard Soroka has taken a new position as Executive Chairman of the Construction Council of Ontario. We thank him for his many years of dedication and leadership to the local and wish him all the best.

Former Pres. Bill Pearse is the new business manager/financial secretary, and Bro. Ed Long is our new president. Congratulations.

Longtime member and contractor Bro. Harry Essbauer has retired. We thank him for his commitment to Local 115 and for all the work his company provided over the years. We wish him and his wife, Pat, a very happy retirement.

Bro. Essbauer has sold the company to Bro. Brad Thompson. The company will become Brad Thompson Electric, and the local will continue to help Brad build a strong union company.

Big Campaign Effort

annual Christmas in October program in October 2002.

L.U. 124 (ees,em,i,mar,rts,se &spa), KANSAS CITY, MOOn Oct. 5, 2002, 124 members volunteered for the annual Christmas in October program, and over 40 homes had electrical repairs done. The program picks an area of Kansas City and then chooses families that cannot afford needed repairs otherwise. All union crafts are involved in the project. Local 124 had the highest turnout of all the crafts, and we thank all who volunteered.

For the elections, Local 124 had 100 volunteers who walked neighborhoods passing out handbills, manned polls, and helped in campaign headquarters. U.S. Senator Jean Carnahan, a Democrat from Missouri, personally thanked the group for their efforts.

January will bring the opening of our recently built addition to the JATC Training Center. New classrooms and computer and welding labs have been added. An open house is planned soon.

The work situation is still slow in our jurisdiction, with over 340 members on Book 1. The New Years wish is for full employment for our Local.

We remember the following deceased members: Adolph Hulen and Louis Brunson.

Congratulations to the following retired members: Vincent Accurso, Gary Clark, Frederick Collins, Charles Crosthwait, Harvey Henry, Richard Miller, Dennis Nixon, and James Wacker.
