NLRB Issues Decision Defining “Supervisor”

The National Labor Relations Board has issued a decision in NLRB v. Kentucky River Community Care, a Supreme Court decision which considered how to define “supervisor” under federal labor law. The decision is critical because supervisors are not protected by the National Labor Relations Act, unlike other employees who can organize and be protected by unions.

From all indications, the NLRB ruling will be used by employers to strip millions of workers of their rights to have a union by making an overly-broad determination of what constitutes “supervisory” work.

The IBEW General Counsel’s office is currently reviewing the decision.  We will post additional information after they report on their review.
